Terms & Conditions
How we quote, make, install and stand behind our work.
These terms apply when you ask Privacy Curtain Co for a quote, book a site survey, or place an order with us. They are written to be read, not to be got past, and they describe how we actually work.
We are a supplier and installer. We measure, fabricate and install privacy curtains and track systems ourselves, for healthcare and commercial facilities in the Bay Area and Sacramento. We are not a marketplace and we do not hand your job to a subcontractor you have not met.
1. Quotes
Nothing on this website is a price. We publish no prices because a curtain job is priced from real measurements — ceiling height, track run, drop, mesh height for sprinkler clearance, and the fabric you choose. Until we have those, any number would be a guess.
A written quote from us is valid for 30 days from its date. After that we may re-quote, because fabric and hardware prices move. A quote covers only what it lists. If something is not written in it, it is not included.
A quote is an offer, not a contract. The contract begins when you accept it in writing and we confirm your order.
2. Site survey
On anything more complicated than a straight run we recommend that we come and measure. A site survey is $250, and it is credited in full to your order if you go ahead with us.
If you would rather measure yourself, you can, and our guide explains how. In that case the measurements are yours, and curtains made to them are made to what you gave us. We will tell you if something you send looks wrong, but we cannot be responsible for a dimension we did not take.
3. Placing an order
Because everything we make is cut to your rooms, we ask for a 50% deposit to start fabrication, with the balance due on completion of the installation. For orders under $2,000 we ask for payment in full up front.
Established accounts may be offered net terms. If you need to buy on a purchase order, tell us before you order and we will tell you what we need.
We do not take payment through this website. Anyone asking you to enter card details here is not us.
4. Custom work cannot be returned
This is the most important term on this page, so it is not buried. Curtains and cut-to-length track are made to your measurements and cannot be returned or exchanged because you changed your mind, ordered the wrong size from your own measurements, or no longer need them. This is normal across our industry and it is why we would rather measure for you.
Uncut stock hardware in its original packaging may be returned within 30 days, subject to a 25% restocking fee, with return carriage paid by you.
None of this affects anything that arrives faulty or wrong, which is covered below and costs you nothing.
5. Changing an order
Tell us as early as you can. Before we cut fabric, most changes cost nothing. Once cutting has started, a change is a new order for the parts affected, and we will quote it before doing anything.
If you cancel before fabrication begins, we refund your deposit less any survey already carried out and any materials already ordered specifically for you. Once fabrication has begun, the deposit is not refundable.
6. Lead times and installation
We quote a lead time with every order, typically two to three weeks from your written approval for standard fabrics. Specialty fabrics and long track runs take longer and we will say so at the time.
A lead time is our honest estimate, not a guarantee. We are not liable for delays outside our control — mill backorders, freight, weather, utility failures, or your site not being ready. If we are going to be late, you will hear it from us before you notice it.
We work around your schedule, including evenings, weekends and phased installs, which is often what a working ward or clinic needs.
7. What we need from you on site
For us to install on the day we agreed, we need safe and clear access to the rooms, working lighting and power, and somewhere to set down materials. Rooms should be clear of patients and of furniture that blocks the track line.
If our crew arrives and cannot work because access was not available, we may charge for the visit and rebook. We would always rather move the date than send a crew for nothing, so tell us as soon as you know.
Where a ceiling, soffit or existing fixing turns out not to be sound enough to carry a track, we will stop, tell you, and quote the remedial work separately. We will not fix a track to something we do not trust.
8. Fire compliance
We supply fabrics that meet NFPA 701, and where the job is in California we supply fabrics registered with the Office of the State Fire Marshal under Title 19 of the California Code of Regulations. We provide the documentation for what we supply, and you should keep it for your inspections.
What we certify is the material and our installation of it. We cannot certify curtains we did not supply, fabric that has been treated, altered or laundered after it left us, or the fire performance of your building as a whole. Mesh height for sprinkler clearance is set from the sprinkler layout you give us or that we record on site.
9. Warranty
Three different things can fail, they fail for different reasons, and it is clearer to say so than to write one sentence that covers all of them.
Our workmanship — one year, no conditions
Track that works loose, a run that is out of true, a fixing that was not right: one year from the date of installation. That is our own work and nothing you do afterwards changes our responsibility for it.
Hardware we supply — one year, no conditions
Track, carriers, stops and fixings, against defects in materials and manufacture, for one year from delivery. Where the manufacturer gives longer, you get the longer one — we pass it through rather than cap it at ours.
Fabric — one year, and it depends on how it is washed
Seams, hems, header tape, colour and the make-up of the curtain: one year from delivery. Like any technical textile, that assumes the curtain has been laundered to its rated wash specification. Washing outside that specification damages fabric, and we cannot warrant something we did not control.
We do not launder curtains — that side is yours to arrange, and plenty of facilities do it in-house. Keep the care label, wash to it, and the warranty stands. We are telling you what the warranty rests on, not adding a condition for you to work around.
What none of the three covers
Normal wear, fading, accidental damage, misuse, alteration by anyone other than us, movement in the building structure, and damage from cleaning agents or wash methods the fabric is not rated for.
If something fails inside its period, tell us and we will repair or replace it at no charge to you. That is the whole of the remedy under this warranty, and it is the remedy we would want ourselves.
Check your delivery when it arrives. Tell us about anything visibly damaged or wrong within 7 days so we can deal with the carrier and get you a replacement quickly.
10. Payment
Invoices are due net 30 from the invoice date unless your quote says otherwise. Overdue balances may carry interest at 1.5% per month, which is the industry norm, and we would much rather never apply it.
Title in the goods stays with us until they are paid for in full. Risk passes to you on delivery or installation.
Our prices exclude sales tax, which is added where it applies.
11. Limits on our liability
We are liable for what we supply and what we install. We are not liable for indirect or consequential loss — lost revenue, lost bed days, or the cost of a delayed opening — and our total liability for any order is limited to the amount you paid us for that order.
Nothing here limits liability for death or personal injury caused by our negligence, or for fraud, or anything else that cannot be limited under California law.
We carry liability insurance and workers’ compensation cover, and we will provide certificates before we come on site if your facility requires them.
12. Using this website
The text, photographs, drawings and guides on this site are ours. You are welcome to read them, print them and use them to specify your job. You may not republish them as your own.
Our measuring guides and fabric information are given in good faith to help you specify well. They are general guidance, not a substitute for a survey, and following them does not transfer responsibility for your measurements to us.
If we give you a Client Portal login, it is for you and the people you authorise. Tell us if you think someone else has it.
13. Privacy
What we do with the information you send us is set out in our Privacy Policy, including your rights under California law.
14. Governing law
These terms are governed by the laws of the State of California, and the courts of California have jurisdiction.
15. Changes to these terms
We may update this page. The terms that apply to your order are the ones in force on the day we confirmed it, and we will send them with your quote if you ask.
16. Talk to us
If any of this is unclear, or if your facility has procurement terms of its own that need to sit alongside ours, email us and a person will answer.
